LRay Villafuerte seeks to postpone the 2025 Barangay and Sangguniang Kabataan elections

Why is LRay Villafuerte keen on pushing what is unconstitutional?

Camarines sur’s Congressman LRay Villafuerte filed House Bill 10344 which seeks to postpone the barangay and Sangguniang Kabataan elections (BSKE) originally scheduled for December 1, 2025. The bill proposes moving the BSKE polls to October 26, 2026, and subsequently holding them every three years thereafter. This legislative measure is being pushed despite the ruling in Macalintal vs. Comelec (G.R. No. 263590/G.R. No. 263673. June 27, 2023) that postponing the BSKE is contrary to the 1987 Philippine Constitution. What benefit, if any, will Villafuerte achieve?

Barangay and SK elections are fundamental to the grassroots democratic framework in the Philippines. They ensure that local leaders are accountable to their constituents and allow young people to participate in governance through the SK. These elections are scheduled regularly to maintain a dynamic and responsive local government structure.

The Supreme Court, in a landmark decision, declared unconstitutional the law postponing the barangay and SK elections. The Court emphasized that the Constitution mandates regular elections to uphold democratic principles and ensure the legitimacy of local governance. According to the ruling, the elections must be held in October 2023, reaffirming the need for periodic electoral exercises to maintain a responsive and accountable government .

Proponents of the postponement, including Congressman Villafuerte, argue that extending the terms of current barangay and SK officials can lead to continuity and stability, especially during challenging times. They suggest that the current officials, having gained experience and familiarity with ongoing projects, are better positioned to steer their communities through periods of crisis or transition. Digging deeper, however, Villafuerte wants to extend the term of the elected SK and barangay officials first as a reward for the latter’s loyalty, and two, as an insurance that these village officials will be useful for his election bid this 2025.

But while HB 10344 is a win for both Villafuerte and his co-proponents on one hand, and the barangay and Sangguniang Kabataan officials on the other, will it be a win for the Filipino people?

Weighing in on Villafuerte’s proposal, the case seems otherwise. While the BSKE for 2025 may entail some costs, the the economic is lesser than the political gains of the voting public.

First, postponement of the BSKE indicates an erosion of the democratic principles. Regular elections are a cornerstone of democracy. Delaying them can set a dangerous precedent, potentially leading to an erosion of democratic norms and accountability. Extending terms without a mandate from the electorate undermines the very essence of representative democracy.

Second, elections serve as a mechanism for holding officials accountable. Postponing elections can lead to complacency and reduce the incentive for officials to perform effectively. Fresh elections provide an opportunity for the electorate to evaluate and either reaffirm or withdraw their support for current officials based on their performance.

Third, the SK elections are particularly crucial for fostering youth engagement in governance. Postponing these elections can disenfranchise young people and delay the entry of new, dynamic leaders into the political arena.

Further, the political implications of postponing elections extend beyond local governance. It can affect the broader political landscape by potentially delaying the emergence of new political actors and ideas. Economically, postponing elections can lead to uncertainty, as local leaders play a significant role in implementing community-based economic initiatives and projects.

While the arguments for continuity and stability are not without merit, the broader implications of postponing barangay and SK elections must be carefully considered. Upholding the Supreme Court ruling and adhering to the scheduled electoral cycle is crucial for maintaining the integrity of the democratic process. Ensuring regular and timely elections reinforces the principles of accountability and responsiveness, which are essential for a vibrant and functioning democracy.

Recommendations

  1. Respect the Supreme Court Ruling: Adhering to the ruling ensures the upholding of constitutional principles and maintains the integrity of the democratic process.
  2. Enhance Support for Current Officials: Instead of postponing elections, the government can provide additional support and resources to current barangay and SK officials to ensure they can effectively manage their responsibilities during challenging times.
  3. Promote Civic Engagement: Encouraging greater civic participation and engagement can help bridge the gap between election cycles, ensuring that local governance remains responsive to the needs of the community.

Ultimately, the commitment to regular elections is a testament to the resilience and strength of the democratic system. It is through this process that the voice of the people is heard, and the legitimacy of local leaders is affirmed.
